Fong, a clinical neuropsychologist who treated Sanderson following the collision, and Richard Boehme, a biomedical engineer who testified as an expert witness, were also played for the jury on Thursday. Boehme evaluated Sanderson in 2021 and testified that he believed the injuries Sanderson sustained to his ribs could have only been the result of being struck from behind. The court documents filed by Sanderson in 2019 alleged that Paltrow “skied out of control … knocking him down hard, knocking him out, and causing a brain injury, and four broken ribs and other serious injuries.” Paltrow’s countersuit claimed that Sanderson had collided with her from behind. The complaint further stated that the ski instructor failed to send help and filed a false report to protect Paltrow. Sanderson also alleged that neither Paltrow nor Deer Valley lodge personnel notified emergency responders about his injuries, and that at least two Deer Valley instructors who were with Paltrow did not call for help. The ski instructor also allegedly filled out an incident report falsely stating that Paltrow did not cause the crash, even though he did not see the incident occur. The trial will resume on Monday, March 27, 2023.
