While the court acknowledged that their actions appeared to be unlawful, it found that they did not have the intention to commit assault. Magistrate Leiland Poonsamy stated that "the evidence in its totality also confirms the version of the accused before the court" and that their version of events is "reasonably possibly true". This led to the acquittal of both Malema and Ndlozi.
